ccording to Jdigital, this measure is “not only unpractical to solve the problems the government parties have been announcing for years with no figures that support them, but it also makes these issues worst, as it contributes to the growth of an unsupervised black market,” they explained.

The association agreed on the convenience of having advertising rules to regulate license operators in Spain, but they said that “the regulatory framework must be efficient and proportionate so it does not weaken the legal market and therefore, DGOJ’s supervisory capacity.”

According to Jdigital, advertising is “a fundamental tool provided by the gaming regulation law to canalize the legitimate demand for a legal online gaming offering supervised by public authorities, and as a consequence, which is safe and responsible.”

It is worth noting that the Supreme Court allowed the appeal filed by Jdigital against the Royal Decree on Commercial Communications. On top of the evident negative financial impact this measure has on online gambling operators in Spain, SJdigital submitted this appeal alleging that the disproportion of the decree will lead to a lack of gamblers’ safety and protection.
